Numerous condominium associations, property owners’ associations, and investor/owners have turned to Eric to pursue defective-construction claims against developers, general contractors, and subcontractors. Eric has recovered millions of dollars for community associations. In a recent construction claim in the Atlanta area, Eric was part of a team that negotiated a multiple seven-figure settlement on behalf of a prominent high-rise condominium. For another metro-area client, Eric developed a litigation strategy and navigated through discovery, motions, and mediations resulting in a significant recovery, which the association was able to use to replenish its reserves that had been depleted prematurely due to excessive repairs.
Eric’s practice also includes defense of construction disputes. In a recent arbitration in North Carolina, Eric helped a major regional subcontractor defend against seven-figure delay claims brought by one of the Southeast’s largest general contractors while pursuing that subcontractor’s own claims for delay, nonpayment, and other contractual disputes. Following a lengthy arbitration with multi-faceted claims and parties, Eric’s client walked away with a significant net recovery.
Eric also represents Belfor USA Group, Inc., the worldwide leader in disaster recovery and property restoration. Eric’s representation of Belfor stretches across Georgia, Florida, and other southeastern states. Eric has helped litigate numerous multi-million dollar claims on Belfor’s behalf, including contract and payment disputes, construction-related torts, and multi-million-dollar lien-enforcement actions.
Eric’s business-litigation practice focuses on contractual disputes and business torts. On behalf of a metro-area community bank, Eric helped litigate a multi-million-dollar fraudulent-transfer case against the guarantor of large development loan that ultimately allowed the bank to collect a seven-figure payout against a “judgment proof” debtor.
Eric also has a history of success litigating claims arising out of business dissolution, business divorces, fraud, misappropriation of corporate assets, and embezzlement. Recently, while defending claims against a large private-equity group with real-estate holdings around the country, Eric obtained an early dismissal of all claims before discovery even began. Eric was also part of a team that successfully defended a multi-state investment group against claims of breach of fiduciary duty, fraud, and misappropriation across multiple jurisdictions.
